Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the website located at https://docologyhealth.ai/ (the "Site"), operated by docology, LLC ("docology," "we," "us," or "our"), a company organized under the laws of the State of Nebraska with a principal place of business at 4601 Catalyst Court, Suite 2050, Omaha, NE 68130.
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Site.
These Terms govern use of docology's public website only. Use of docology's products and services by our healthcare partners and their staff is governed by separate written agreements between docology and that partner.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to the Site, our systems, or related networks
- Use any automated system (bots, scrapers, crawlers) to access or extract data from the Site without our permission
- Interfere with or disrupt the operation of the Site
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Upload or transmit viruses, malware, or other harmful code
- Use the Site to compete with docology or for any unauthorized commercial purpose
- Submit patient information or protected health information (PHI) through the Site; the Site is not a secure channel for PHI
2. Intellectual Property
The Site and its content — including text, graphics, logos, software, and design — are owned by docology or our licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business reference. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission, except as necessary to view and print pages for your own reference.
The "docology" name and logo are trademarks of docology, LLC. You may not use them without our prior written consent.
3. Submissions and Feedback
If you send us questions, suggestions, or feedback about the Site or our services, you grant docology the right to use that feedback for any purpose, without compensation or attribution to you. Do not submit anything through the Site that is unlawful, infringing, or that you don't have the right to share.
4. Third-Party Links
The Site may link to third-party websites we don't control. We are not responsible for the content or practices of those sites, and including a link does not imply our endorsement.
5. Geographic Restrictions
The Site is intended for use by persons located in the United States. We make no claims that the Site or its content is accessible, appropriate, or lawful to use outside the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
6. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DOCOLOGY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
8. Indemnification
You agree to defend, indemnify, and hold docology harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or your violation of these Terms.
9. Modifications to the Site or These Terms
We may update these Terms at any time by posting a revised version with an updated "Last Updated" date. Continued use of the Site after changes are posted means you accept the updated Terms. We may also modify, suspend, or discontinue the Site, in whole or in part, at any time without notice or liability to you.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Nebraska, and you consent to personal jurisdiction and venue there.
11. Termination
We may restrict, suspend, or terminate your access to the Site at any time, for any reason, without notice.
12. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and docology regarding the Site. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later.
We may assign this agreement, in whole or in part, at any time without notice to you, including in connection with a merger, acquisition, financing, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.
We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, acts of government, labor disputes, or internet or telecommunications failures.
